If not, you can't activate the device but may be able to get it refunded. Apple won't remove the lock for anyone other than the original owner(assuming they're alive.)

That’s impossible. You need to use a method provided by eBay to contact the seller; they’re not necessarily the person who set the lock.

Only as Niel said. If you cannot contact the original owner then ask eBay for a refund as the device is no use to you else wise.
