I bought an iphone 5s and the seller erased his icloud account but after updating it it request an icloud account to activate it what can i do?

The previous owner did not release the device from his registration and is now in Activation Lock. Only that person can unlock it now. Else it is a useless bit of junk. You might have been sold a stolen device.
