Metadata lost when downloading from icloud photo library?

When I download my photos and videos from the icloud photo library I lose the metadata and it automatically saves the date and time the photo or video was downloaded instead of when the file was actually taken? I have smart folders in iphoto 09 that saves my videos by year so I can make dvds at the end of each year and now the videos are not in order. Does anyone have suggestions on how to fix this or an app that will work the same as iphoto 09 does when organizing videos.
