Do we think this will be able to be upgraded obviously by voiding warranty? would love to put more than 128gb in there

I would say no since the memory is soldered to the logic board.
I hope you don't mind my asking why you would put that kind of money into a brand new device with a 1-year limited warranty and want to void that warranty right away to try and change the capacity?
Because right now i have an Ipod classic custom at 250gb, i would love to get a touch but 128gb is still kind of low for me
One of the unfortunate things about flash storage. I was bummed when they quit the Classic, however then I realized that no matter what I did, I never really needed to have access to all of that music. Despite the fact that I have all of my music library on my iPhone (I know, it isn't that large a library, only 8GB) I generally only access a portion of it. I looked the other day and I was surprised at the number of songs that I haven't played in a very long time.
Eventually, flash storage will increase, but to keep costs low and maintain the small sizes, they are currently restricted in what they can use.
