Not on your own; the activation lock is an anti-theft measure.
If you're able to contact the person who set the lock, send them this link and tell them to follow its instructions.
If not, you can't activate the device but may be able to get it refunded. Apple won't remove the lock for anyone other than the original owner(assuming they're alive.)

I bought an ipod touch off a friend for music while working out and he sold me a locked ipod. when i tried holding the eep and wake button it is trying to make me put in someones apple id . is there any way i can fix this and not get screwed?
