how can i update my daughters iPod touch if the apple id is old and no longer valid

You would have to sign out o the apple id and make a new one

Are you referring to the iCloud account? You will need the password or proof of purchase (which you can bring to Apple) to remove the account from the device.

What do you mean by not valid?

If you forgot the ID/password then:

If you forgot your Apple ID - Apple Support

If you forgot your Apple ID password - Apple Support

last, contact iTunes to recover use of the accout so you can sign out
