If locked due to passcode mesentery, you have to restore by using the recovery mode, http://support.apple.com/kb/HT1212 to connect to a computer running iTunes.
If it is locked due to the iCloud Find My Phone activation lock, you have to have the AppleID password to remove that lock, there is no other way to release it.
If it is locked to a carrier, you have to deal with the cellular service provider to unlock the iPhone as Apple will not assist with that.
