If they claim you need to take it up with Apple, I would suggst doing just that, with any and all info you have from your contact with the app's developer (names of people you spoke to, exactly what was explained to them, and how they replied.) You can generally schedule a callback from Apple with mac app store related purchases, and don't need a device with Applecare coverage.
