Try going to http://www.icloud.com using a computer's browser.  Are all your iCloud contacts visible there?

If you are logged into iCloud on your 4S and have selected contacts are the slide goes green. It should automatically start uploading into the cloud. Best way to check if they have been uploaded is visiting iCloud.com.

Also make sure on your 4 that you have also signed into your apple id that you are using on your 4S and also have contacts have been slide to green

Very likely you created some of the contacts (those missing from iCloud) before you set up that iCloud account and/or before you established the connection to iCloud when using your contacts.  Those missing from iCloud are housed somewhere else - most likely only on the iPhone where you entered them.

No, backups do not include Contacts. Contacts are housed in iCloud as sberman indicated. They are not "backed up". They just live in iCloud and are pushed to any device or computer that is signed into that iCloud account with Contacts turned on.

On your iPhone 4s, go to Settings>iCloud, scroll to the bottom of the screen and Sign out of iCloud. It will ask if you want to Keep your Contacts on your device - select KEEP. Then sign back in to iCloud on the device. It will ask if you want to Merge your Contacts with iCloud. Say YES and it should merge all of the Contacts on your device to iCloud.
