If defective, within the one-year warranty whcich it seems it is, and not abused Apple will exchange it for a refurbished one at no cost

Apple will exchange your iPod for a refurbished one for $99 for a 16 GB 5G and $149 for the other 5Gs They do not fix yours.
You can also send it in to Apple. See:

Note that if you, or a place not authorized by Apple take it apart/repair it, Apple will not then exchange it.
