It sounds to me like you've fallen victim to a scam. You bought a phone that was subsequently reported lost or stolen by the original owner so that they could collect on insurance, or they skipped out on their bill, not paying off the phone, and it was subsequently blacklisted by the carrier.

Updating it will not "un-blacklist" the phone. Since it requires a SIM to activate, that means you may not be able to activate it again.
File a claim with eBay and get your money back. What the seller did is fraud.
