iPhone 5 screen popped up

Hello,

my device was purchased from the States more exactly from a Apple Store in Charlotte NC. I have the issue that the screen is loose/popped up and the device is getting very hot. I assume it is the battery but checking the program it says that I'm not eligible for the change program. I wrote an email to the local apple service ( http://www.voxstore.ro/ )(I'm located in Romania, Europe ) but no answer . This is clear a faulty manufacture issue and I expect also that it will be solved .

The question is what can I do ? Thank you
