Can you upgrade from 10.8 to 10.9 even through 10.10 has been released?

I am running 10.8 and have neglected to upgrade to 10.9 due to compatibility issues with my CAD program

It is not safe to do this, but 10.10 has been released.

I am not sure if it is possible to make the 10.8 to 10.9 upgrade now. Any help would be appreciated.

Mac Pro, Mac OS X (10.6.8)

No. 10.9 can only be downloaded if you have not purchased it prior to the release of 10.10. It is no longer available for purchase now.

Why would you want to upgrade to an older version of the operating system anyway?
