The previous owner of my iPhone 5s has my phone on activation locked, he will not turn it off, what can I do?

The seller will need to remove the lock. There is no other option.

Return the phone and get another one without a ******* previous owner. Its not right for anyone to hold an activation lock on a phone that doesn't belong to them anymore.
Get your money back. If the previous owner won't remove the Activation Lock, then you have been sold a bill of goods....
