Syncing a New iPod to an old Back-Up

My 4Gen iPod Touch recently died, and I want to get a new one. But, because it died suddenly, I didn't have a chance to backup all the data (photos, notes etc) outside iTunes, and I can't seem to get hold of them via iTunes. So, I guess I need to sync the old iTunes backup with a new iPod. Now, can I do that with a more up-to-date iPod (say a 5Gen) or do I have to stick to a 4Gen?

I'm sorry, but that's still not really answering the question. Would a new Gen, with a later iOS, still accept the backup?

Yes. You can restore a new device with an iOS version equal to or greater than the verions the backup was made.

For example, you can restore an iOS 9 or 8 device from a backup made on an iOS 6 device.
