what ios is a 4th generation supposed to have. I have 2 of them and they keep saying they are updated with the most recent one and its ios 6.1.6
is that right because my ipad is 9.1

Because you need a newer device which supports a later iOS version if you want to use the app. You might be able to download an older version of the app on iOS 6: App Store: Downloading Older Versions of Apps.
