If your Smart Mailboxes are empty, then reindexing Spotlight and/or forcing the Mail "mdworker" and "mds" processes to quit and refresh may resolve your issue.
Here's how to do this:
Re-Index Spotlight
- From the Apple () menu, choose System Preferences.
- Click Spotlight.
- Click the Privacy tab.
- Drag a folder or an entire volume (your hard drive) to the list.
- If prompted for confirmation, click OK.
- Remove the item or volume you just added to the list by clicking it and then clicking the minus ("-") button.
- Close Spotlight preferences.
Spotlight will re-index the contents of the folder or volume.
Use Activity Monitor to quit processes
- Open Finder and open the Applications folder
- Open the Utilities folder
- Open Activity Monitor
- From the menu bar, choose View > All Processes
- In the search box, type "mds" (without the quotes)
- Select and quit (click on the X in the top left) for each process that contains "mds" or "mdserver"
- Restart your computer
