i lost my iPhone 4s but have an old iPhone 4 which belonged to my wife - i have tried to restore my old 4s contents onto the 4 but it wouldn't let me and suggested that i didn't have the latest update. i then restored my wifes settings and tried to update the iPhone 4 and there was not one available!!

First set up the iPhone 4 as a new device. Log in with your Apple ID and update iOS. When the 4 is on the same, or newer, iOS version, you'll be able to Restore from the 4s backup.
It isn’t possible to update an iPhone 4 past 7.1.2. If the backup was made from a newer iOS version, it’ll need to be opened with the iPhone Backup Extractor and its contents manually put on the iPhone 4; this is only possible for backups made to a computer.

The iPhone Backup Extractor is a tool you download and run yourself; once it’s been used, the instructions are different for each type of content.

If the 4S has an iOS version that's later than the 4, you won't be able to restore the backup to the 4; sorry.
