Take the phone along with proof of purchase for the phone to the genius bar at your local Apple Store. They can remove the activation lock.

I don't have proof of purchase but I will take id with me with proof of address, hopefully this will suffice.
No. It won't. Sorry. Activation lock is an anti-theft measure. If you don't have original proof of purchase for the device from an authorized source, and can not prove ownership of the account used to lock it, it's a brick. Apple won't do anything about it.
