Q: ICloud saves my Photos but it should NOT!

Hi Apple I recently upgraded from Iphone 5 to an Iphone 6S. It was nice that I could use my old Icloud Backup from the Iphone 5 to get all my Settings and Apps on the new 6S. But as the Backup was finished I could not believe it ... all the Photos from my old Phone are on the new one! I never told ICloud to Backup any of my Photos or Videos (Photo Option in ICloud Settings unchecked). The Backup to the new phone was done over Wifi ... no ITunes involved!

Can you please tell me why ICloud saves my Photos?

iPhone 6s, iOS 9.0.2, null

iCloud backups save your camera roll images, regardless of the setting you have in Settings >> iCloud >> Photos.

If you want to select what iCloud actually backs up, see this: iCloud: Back up fewer apps to save storage (this may not be the right spot for that - someone else may need to chime in.)

ALL Photos and videos are there from the old phone ... about 1000+ pictures ... way more than 5GB I have in my icloud storage ... and the Backup only needs 2.6GB this cant be!

So Apple is pulling ALL my private Stuff from the old Phone and saves it in the Cloud ... that's not what I want! THX NSA!

iCloud: iCloud storage and backup overview

Look at the part about photos.

When iCloud does a backup it backs up the entire phone no matter what settings you have turned off...

Those settings apply to information that would be transferred without using a backup and what would be accessible if say you signed into an iPad.

You gave them permission to back up you photos when you turned on iCloud backups. If you're that paranoid, then turn it off, delete the backups from iCloud, and sign out of iCloud on all your devices.

You gave it permission when you said you wanted your iPhone backed up. The backup includes most things on your phone, including photos, unless you have Photo Stream or iCloud Photos enabled. But if you do have either those enabled, then your photos will appear on all devices that share your iCloud ID.

You cannot be selective about what is backed up. It's all or nothing. See Transfer content from an iPhone, iPad, or iPod touch to a new device - Apple Support and this: About backups in iCloud and iTunes - Apple Support to understand what is backed up.

iCloud backups are always encrypted, so only you can restore them. Your privacy is assured, unless you have an insecure iCloud password.

You Guys killing me ... if Icloud Backups my whole Phone than the Backup would be HUGE with all the Photos and Videos ... way more Space is needed than the 5GB. And i have turned off all Stuff saving Photos to ICloud!

I suggest you read the links I posted. They explain exactly what is backed up. Hint: Anything purchased from iTunes (music, videos, apps, podcasts, iBooks) is NOT backed up, because it can be redownloaded. What IS backed up is data from apps such as game statistics, and any app data not synced to iCloud. To see what is synced to iCloud go to Settings/iCloud and see what is turned on. For example, if you do not sync calendars, contacts, notes, et al to iCloud they will be included in the backup. If you have any (or all of them) turned on for iCloud sync they will not be included in the backup, because they will sync via iCloud. The same for photos. If you have iCloud Photos turned on they will not be in the backup, but will sync to any device that shares an Apple ID. If you have Photos turned off they will be included in the backup.
