'Float on top' option in notes stopped working after upgrading to El Capitan.

I have an early 2015 13inch MacBook Pro with Retina display, 8gb memory.

Since upgrading to El Capitan (10.11.1) the option to 'Float On Top' in Notes 4.0 has stopped working.

When viewing a single note I can see the option in the menu, however it is greyed out and nothing I do seems to have any effect.

I have noticed posts from people on other sites experiencing the same problem but haven't been able to find a work around.

Can anyone here help?

Same issue--I just realized today though that Float on top still works for some of my notes. I can't figure out why. I thought it might be only notes created before a certain date, but that's not it. I thought it might be notes with styled text, but that's not it. Notes with images? No. iCloud vs local notes? No.

Very strange but I will continue to test.
