is there a warranty on ear pods

I have a pair of ear pods where the sound cuts in and out. When I went to the store they were going to sign me up for a genius bar appointment but I did not have an extra hour to spare. Are ear pods something that Apple replaces? If so, for how long? I don't have a serial number for the ear pods so getting actual support from Apple has been frustrating.
