Has the phone been set up with your Apple ID and password when you bought it and set it up for the first time?

If yes, the Activation Lock is still active for your device and your Apple ID.

Check this article about it: Find My iPhone Activation Lock

If you activated "Find my iPhone" when you first set it up, it can not be set up by another person, using a different Apple ID.

If you did not activate "Find my iPhone" and the phone has been set up with a different Apple ID after it has been stolen and the thief enabled the Activation Lock for his iCloud account, the phone can't be used either, sorry.
