New 5s with iOS 7.1.2 on it

I'm wanting to set this up for the first time through iCloud backup, however the phone says that it will not accept iCloud as a back up due to it being a later version...(iOS 8.2 i think.) how do I proceed?

Set it up as a new device, update it to 9.1, and then restore the backup.

You'll need to set the iPhone up as a new device. Then update the iOS version to the most recent one, and then restore again to use the backup made on the newer iOS version.
