What leads you to believe that "the item does not have tax"? No idea where you are, but in the US, if Apple has a physical presence in your state, and there is sales tax in your state, the item is taxable.
I am in the US and well aware of tax laws. it is an in app purchase that i have made several times before and there has never been tax nor will there be this time.
