ipod 5th has never been able to update, i do my iphone all the time. tells me 6.1.6 is up to date.
ipod touch 5th gen has never been able to up date from 6.1.6. I do my iPhone all the time and it has 12.1GB available.

An iPod touch running iOS 6.1.6 is a fourth generation model, not a fifth generation one, and can't run iOS 7 or above.
