Right now about the only thing you can do is take it to the Apple Store for a refund/exchange.

indeed this is what I did. it seems there an "issue" with some of the pens that it seemed that Apple "knows about".

Thanks for the update. Glad to hear everything worked out for you. I'd been looking at th Pencil and noticed it doesn't come apart, if something goes wrong it gets tossd in the garabage. Fortunately you got a new Pencil.
