Trash Bin Won't Clear

This is an issue which has been bothering me for probably about a year. Everytime I go to clear my trash bin I get a notice that certain files are in use and it cant clear them. Its so infuriating to me because these files, mostly old word docs or photos dont exist when you try to trace them to their root. I have tried the "hold option and clear trash" I have also tried using terminal and I receive the below response. Does anyone know what I can do!? This is driving me insane!

Password:

rm: /Users/bryanbobo/.Trash: No such file or directory

Imac, Mac OS X (10.6.3)
