If it is still asking for the previous owner's password, then they did not successfully remove it from their iCloud account. They will need to do that for you to be able to use it. Until that time it is useless to you, and Apple cannot help. They will only help the original owner, with the original receipt. If it is just the iCloud ID password they cannot remember, then they need to contact Apple to recover their password.
