You are describing Activation Lock, which prevents unauthorised use of Apple Watch if it is lost or stolen.
To be able to pair it to your own iPhone, you need the previous owner to either:
Sign in with their Apple ID > Settings > My Devices > Click on Apple Watch > Click on the "X" > click on Remove.
Unless one or the other of these processes is followed, you will be unable to use the watch (there is no way around this security feature).
Your only other solution is therefore to return the watch to the seller for a refund.
Since you purchased this "brand new" and discovered the Watch is already Activation Locked you should return it to where you purchased it and either get a refund or have the seller turn that feature off.
same thing happend to me, I got a watch for my husband andi purchased it online at Best Buy.com and went to the store to pick it up
Return it.
AS soon as they open Saturday morning I will, it's b.s. A big known company is doing this.
What "gib known company" would that be? We have no idea where you bought it.

Best Buy sells used Apple Watch models, which are referred to as "open box" products. These items are "products returned under Best Buy Return & Exchange Promise".
Activation Lock (which protects the watch from being used if it is lost or stolen) is turned on automatically when an owner has set up Find My iPhone on their paired iPhone. If a buyer changes their mind after purchasing Apple Watch, but they do not unpair it via the Watch app on iPhone before returning it to the retailer, the watch remains protected by Activation Lock.
Such watches cannot be used by a subsequent purchaser unless and until Activation Lock is removed by the previous owner. In the case of buying a locked watch from a large retailer, this is unlikely to be possible, so the watch should be returned for exchange or refund, as I advised in my previous reply.
