magic mouse not scrolling - el capitan

recently updated to el capitan and magic mouse has stopped scrolling checked under mouse settings and accessibility but still no luck.

followed If your Apple wireless mouse, keyboard, or trackpad aren't working as expected - Apple Support

and also had no luck.

it seems when i go under mouse settings i don't have a scroll option like some other comments i have seen.

it was working before the update and i can't seem to find why it stopped.

is there a new way that I'm not hip to?

any help is greatly appreciated. thank you in advance!
