If the phone is locked to someone else's Apple ID, they will need to remove if from their account. If you can't get them to do that, the phone is useless.

Apple Is big comapanyThe fact that Apple is a big company has nothing to do with your issue. Activation Lock is an anti-theft measure. Unless you can present Apple with proof of original purchase, they will not remove the Activation Lock.
