If it has a passcode, odds are it is also activation locked.

You can get past the passcode by putting into recovery mode and restoring the phone with iTunes.

If it is activation locked, there is no way to bypass that. If you find that it is activation locked, turn it over to the police and give them all the information you have on who you bought it from. It's most likely stolen.

There is a good chance the device is stolen, but to complicate that, depending on the phone model, it probably has Activation Lock on it and you would not be able to get past that, and no one, even Apple could assist you with that. That is reserved for the original owner of the device. While you can attempt to restore the phone, it probably won't work, and you will be left with a brick, which is no worse off than you are right now. I wouldn't count on the police getting your money back either. They would have to be able to prove intent on the part of the seller, and then they would be charged, the case would have to go to court and the seller, if convicted, would have to be ordered by the court to pay you restitution. That is looking for a lot, considering the state of the criminal justice system.
