If you mean in the Photos application, if you right click on the photo, then highlight "Share" then highlight "Set Desktop Picture" and left click, it should work.
Do you get an error?
You do set the background picture in SystemPreferences as said from Munich or you do it from a photo app, like Photos, by "right" click on the picture, and select "share", then select "set desktop picture". The picture should be physically in the Photos app: even if you see the picture, be aware that it is just a small preview and not the picture itself. Thus check the picture by rightclicking and select "Show referenced picture in Finder". If it is in the Finder the Desktop picture setting does work, If not the Desktop picture setting will not work.

Thanks I cannot do it in System preferences because I don't see photo application mentioned there. I tried with some photos works with other doesn't' appear whenI check system preference to see if is changing why this ?
I forgot this feature with right click on picture is not shown
In SystemPreferences->Desktop->Desktop tab:
click the + sign underneath and choose the folder where the pictures are (or pick just one picture), then select the one you want to use. These new added will stay there for the next time.
check the picture by rightc licking and select "Show referenced picture in Finder" doesn't appear in right click
Post a screenshot of where and what you are clicking on.
I think you need to start over. To change the desktop picture…
1. right click on the Desktop and choose "Change Desktop Background…"
that opens System Preferences>Desktop & Screen Saver
Then you just click on the folder that contains the picture you want to use in the left column then click on the picture on the right.
