The buttons on the remote are just mechanical switches and it sounds like your remote switch is bad. I would take the unit back under warranty and get a replacement.

On the iPad download the Apple remote app on it and follow the instructions to pair it with the Apple TV.

Jun 13, 2016 9:20 PM in response to KevP3860by Hapa88,I just had this problem and tried resetting the Siri Remote by pressing and holding the "Menu" button and the "Volume Up" simultaneously for 3 seconds. It seemed to have fixed the problem.
