cant download any apps on iphone 6 after factory reset

i got my brothers iphone and he factory reset it and now im trying to set it up and i try to download an app and the wheel starts spinning but then it just goes back to get. obviously i am signed in. I have changed region, restarted a few times, logged out and back in.

any other suggestions???
