Not enough info. You need to tell us what iOS you are running, whether or not you are using iCloud Photo Library, or if you mean Photo Stream photos, and the general context of your question.

We cannot see your phone or your setup, so you need to draw a picture....

If photos are stored in iCloud, they should stay there permanently unless removed later. iCloud is kept with your Apple ID, so if your phone were to break, you would still have them on other devices. All you have to do is sign in to the old Apple ID.

Not wholly accurate. If they are stored in iCloud Photo Library, they should stay, but if the OP is referring to Photo Stream (which is kept in iCloud - not iCloud Photo Library), or to photos in iCloud backups (which are kept in iCloud), then that is not the case. Specificity is critical here. iCloud and iCloud Photo Library are not the same thing....
