You can make an appointment at the Genius Bar of the nearest Apple store to have the device examined by Apple. If the device is still under warranty and it is determined that there is a warranty issue, Apple would make that determination. This is a user to user support forum, and no one here could make that call for Apple. Only they could make that determination.
