how do i activate my ifone 4S if this device hasn't been removed from 'find my ifone' of previous owner and previous owner is not available at all?

Sorry but there is no way to bypass the activation lock.
You need to contact the seller and ask him to remove this iPhone from his list of devices. Otherwise, your iPhone will be a useless brick.
