Been given an iPhone 4s by my father In law but its asking me for the apple id to the phone when he set it up which he don't know.

Bring the phone and the documents of original ownership to an Apple store
He is going to have to do one of two things. Either attempt to recover the ID and password with https://iforgot.apple.com or take the device and the original receipt to Apple to ask for help. He will have to make the trip to Apple since he is the original owner.
Can this be dine over the phone as my father in law is disabled and can't walk far.
You can call Apple and find out but unlikely
