When using time machine with migration assistant will it overwrite newer apps like iMovie on a new computer? Or is migration assistant smart enough not to overwrite more recent versions of apps?

No. It will not replace a newer version on the target machine with an older version from the source device. But it will replace older versions with newer ones. If this is a problem for you, then uncheck the option to transfer applications.
