Three time repair replacement policy?

I have heard that if you get your Macbook Pro repaired three times for the same problem and you still have the problem the they have to give you a new one. Is this true? Where is it actually written that this is the policy?

I have gotten mine repaired three times becaue of a propeller type noise, and they still can't fix it. But as i am in Australia, I don't know if that policy applies over here. Do they have to give you the newest one? Or just one of equal value? And is there a chance to upgrade? I guess I am just looking for someone who has gone through this process before.

I would just like to have it fixed without having to lose the computer for a week again. But I like to know what my rights are before going in again.

Macbook pro 15", Mac OS X (10.4.8), 2.0 ghz

User uploaded fileI do recall reading it somewhere, outside of these or any other discussions, although for the life of me I can't completely remember where. Yes there is a policy although as you mention, it's at their descretion.

Having had a computer replaced myself by Apple I can tell you that much of it comes down to how you interact with Apple that will get you a new one or not.
