because firstly It is their email and id you do not know the password and accessing someones property is illegal . Secondly , If the email belongs to someone else you cannot do much about it . That closes the topic

But if that someone reseted your passcode and you don't know what is your passcode, the only way to use your phone is probably to reset it with iTunes and begin again. That would remove the Find My iPhone data too. Though all your data is gone.

You should not be using someone else's Apple ID. Nobody is going to help you reset the password of someone else's Apple ID, that's actually borderline criminal.
If you want to use this phone, reset it to factory settings and don't restore any existing back-ups. Start using it as new with an Apple ID of your own.
