How can I delete the password without affecting the iPhone

I recently found an iPhone 4s in the street. The guy who used to own the iPhone 4s dropped it in the grass by accident, and over time, in 2015, it got buried, it is his iPhone, now he has an iPhone 6s. It is also on iOS 9.0.2 too, but when I found it out, it's password is locked, so I need to unlock it. I don't even know the password, and he never plans to sell it, he also forgot the password of the iPhone too. When I bring it in, I don't want to update it to iOS 9.2.1, so I am gonna keep it on iOS 9.0.2. But, when I access iTunes, it tells me to enter the password. I don't know what to do?

You CAN'T do it. Apple won't help you. In order to have the activation lock removed, you either have to have the credentials for the account used to lock it, or you must be able to provide the original proof of purchase for the phone from an authorized source.

It's useless to you. Recycle it.
