Apple will fix this problem ln a few days .
A lot of people having problems with older devices .

I had the problem with an iPhone 4S, too. Over the air update didn't work. I connected the iPhone to my Mac, startet iTunes and downloaded the update for later install. After the download was finished I did the update from iTunes. That worked for me. FYI: I have the latest OS X and the latest iTunes version running.
If nothing helps you can make an Genius Bar appointment in your nearest Apple Store and they'll have a look.
