Q: Keeps asking for password for previous owner

I Purchased an iPhone4 from a lady on EBay.

however I have been unable to use this as it keeps saying this iPhone is linked to someone else and shows their email and Ive to enter a password.

of course I cannot as I have my own apple ID.

I Have contacted the lady asking she removes this device from her list but she says shes unsure .

contacted support who provided a number for her to contact and they will guide her how to, trouble the lady is deaf and cannot use telephone.

again spoke to Apple support, provided them with proof if purchase online also auction details, the ladys email which is linked, provided emei number and serial number found on sim slot of the phone and was told they send this to the ones who activate etc.

now received another email asking me to once again contact apple support on relevant department, which means start from the beginning again :-(

what happened to everything I provided to put my case forward?

im at my wits end now

iPad, iOS 9.0.1

Here is what the lady needs to do:

What to do before selling or giving away your iPhone, iPad, or iPod touch - Apple Support

(It can be done remotely.)  Unfortunately, I believe Apple Support will only deal with the ORIGINAL owner and Apple will not help you to defeat activation lock.  If the seller will not cooperate or for whatever reason can not remove the device from their iCloud account, then you will never be able to use that device yourself. Its a brick. Try to get your money back.  You may have to go through eBay's buyer protection plan.  But don't delay, I believe eBay has a time limit as to when they will help you and they are very strict about it.  See also:

Your seller on ebay defrauded you and gave you device that will never be activated. She either have to deactivate it or you may want to return device. If she does not want to refund, file claim with ebay. Apple support will not be able to help, cause activation department compares your receipt with original date of purchase and since your purchase was done later on ebay they do not match. Next time buy from reputable seller.
