and when I try to hard reset through iTunes (update & restore hard reset) it ends up saying it needs a passcode...even after updating it. I checked the IMEI and it doesn't register as stolen what can I do? It's obviously never been backed up to my computer. Thanks in advance.

It requires the Apple ID and password of the previous owner. If you don't have it and cannot get it, then the device is useless to you. Return it for a refund if you can.
