Turn off Find My iPhone Activation Lock
the only use for the iPod is as a poor flashlight (light provided by the screen).
Maybe the device was lost or stolen

Apr 17, 2016 12:59 PM in response to lllaassby B Alexander,Well I didnt think twice because he had the password? And stating the obvious, I havnt bought a used apple product in a long time. Is there anyway to find the persons email ir where they purchased the ipod? Thank yoy for the advice.

You can try the following to allow yo to restore the device:
Place the iOS device in Recovery Mode and then connect to your computer and restore via iTunes. The iPod will be erased.
If you forgot the passcode for your iPhone, iPad, or iPod touch, or your device is disabled
If recovery mode does not work try DFU mode.

However, if the device has iOS 7 or later and if the person did not remove the device from their account (link in my previous reply) you will still need to enter the Apple ID and password previously used in Settings>iCloud
