Sorry nothing you can do without the previous owner removing the icloud activation lock.

if you bought the phone from ebay then return it and get your money back.

The fact the device is still under warranty has nothing to do with your problem.

You are not the original owner of the device. Apple will not help you to unlock the device.

If the former owner refuses to unlock the device, as it appears it correct from your other posts, then the device is worthless to you. You will not be able to use it at all. Get your money back!

doesn't matter if it is under warranty, Apple won't help you unlock it.

As already in all of the response from other user, only the original owner can unlock the phone.
