HELP

I don't know what I should do I recently bought a iphone and a ipod touch off craigslist trying to spoil myself. Everytime was great when I got home all of a sudden there is a passcode on the iphone and the ipod has someones icloud account on it! I have been researching what I can do and yes I was obviously scammed person I bought from phone is busy line. Called apple Said it mostly likely will be blacklisted soon. Anyone? Ior pretty much sol right?
